Terms of Service

These terms govern your use of TherapyDraft — the website at therapydraft.com and the TherapyDraft macOS application. By downloading, installing, or using the app, or by joining the waitlist, you agree to these terms. If you don't agree, don't use the service.
1. Who we are
TherapyDraft is operated by the maintainer reachable at hello@therapydraft.com. These terms form a contract between you and us.
2. The license you're buying
A paid TherapyDraft subscription grants you a personal, non-transferable, non-sublicensable license to install and use the TherapyDraft macOS app on the number of Macs included in your plan. On the Group plan, each seat is a single clinician — seats cannot be shared between people.
You may not:
- Use TherapyDraft for any illegal purpose or in violation of applicable professional-licensure rules.
- Reverse-engineer, decompile, extract, or redistribute the model weights or the application binary beyond what is expressly allowed by the underlying model licenses (Qwen2.5, Llama 3.1, whisper.cpp — see the About screen in the app).
- Share a Solo license across multiple clinicians (each clinician needs their own seat).
- Represent TherapyDraft as a HIPAA-covered product. As our Privacy Policy explains, TherapyDraft is a local tool; HIPAA compliance remains your obligation as the covered entity.
- Probe the application or the website for vulnerabilities without coordinating with security@therapydraft.com (see Security below).
3. Your clinical content
You retain 100% ownership of every session recording, transcript, and draft note TherapyDraft produces for you. We have no license to that content, and we cannot — by the architecture of the product — access it. See the Privacy Policy for the full architectural guarantee.
TherapyDraft will never use your content to train, fine-tune, or improve any model. This is not a promise bolted on top of cloud processing; it is a property of a product that never transmits the content in the first place.
4. The service, as-is
We provide the service "as is" without warranties. TherapyDraft drafts clinical notes; you review and finalize them. You are responsible for the accuracy, completeness, and clinical appropriateness of every note you submit to your EHR, present to a client, or use for billing. TherapyDraft is a drafting aid, not a substitute for professional clinical judgment.
We try hard to keep uptime of the license-activation and update servers high. If the activation endpoint is unavailable, the app continues to function for at least 30 days on an existing license — your clinical work is not gated on our servers.
5. Payments & cancellation
- Prices are shown on the pricing page in US dollars, excluding applicable sales tax.
- We bill monthly or annually in advance via Stripe. We do not store your card number.
- You can cancel any time from the billing portal. We don't prorate refunds for the current billing period, but you won't be charged for future periods.
- If a charge fails, we retry for seven days. If it still fails, the license enters a grace period for seven more days, then pauses until you re-activate.
- The free trial includes up to 10 drafted sessions. No credit card is required to start.
6. Refunds
Not satisfied within the first 14 days of a new paid plan? Email hello@therapydraft.com and we'll refund you in full, no questions asked. After 14 days, refunds are at our discretion for unusual cases (prolonged outage, material misrepresentation).
7. Termination
You can cancel any time. We may terminate accounts that violate these terms, with 14 days' written notice where practical; shorter notice where violation is ongoing and harmful (e.g. resale, abuse). On termination we delete your account data per the Privacy Policy.
8. Liability
Our total liability to you for any claim arising from the service is limited to what you have paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or incidental damages (lost profits, lost clinical time, missed billing deadlines). These limits apply to the maximum extent permitted by law; they do not exclude liability that cannot be excluded under applicable consumer-protection law.
9. Security & disclosure
Report security issues to security@therapydraft.com. We will not pursue legal action against good-faith researchers who follow standard coordinated disclosure. Please give us 90 days to fix issues before public disclosure.
10. Changes
We may update these terms. For material changes (new fees, new data collection, new restrictions on use), we'll notify registered users at least 14 days before the change takes effect. If you don't accept the new terms, you can cancel before they take effect.
11. Governing law
These terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. Disputes are resolved in the state or federal courts of Delaware, unless your local consumer-protection laws require otherwise.
